General conditions of sale
These general terms and conditions of sale are concluded on the one hand by the company LCP SARL whose registered office is located at 41 rue de Richelieu 75001 Paris, registered in the Paris trade and companies register under SIREN number 400 548 483 hereinafter referred to as "LCP SARL" and on the other hand, by any natural or legal person wishing to make a purchase via the website DOMAINEDJABOURIAN.COM hereinafter referred to as "the Customer."
The Professional Customer within the meaning of these General Terms and Conditions is defined as any customer, natural or legal person who is registered in the trade register or the trades directory, who contracts for purposes that do not fall within the scope of his commercial or professional activity, namely that the transaction he carries out with LCP SARL is not intended to resell to his end customers within the scope of his activity. The Professional Customer is assimilated within the framework of the contractual relationship to a non-professional within the meaning of the definition of the introductory article of the Consumer Code. The Professional Customer undertakes not to trade in products purchased on the DOMAINEDJABOURIAN.COM website.
Purpose of the contract
The purpose of these general terms and conditions of sale is to establish the contractual provisions between LCP SARL and the Customer and the conditions applicable to any purchase made through the DOMAINEDJABOURIAN.COM merchant site, for the consumer. The acquisition of a good or service through this site implies unreserved acceptance by the customer of these general terms and conditions of sale.
Legal information
LCP SARL collects personal data concerning the buyer as well as, where applicable, that of the recipient of the Order, all the data collected is necessary for the processing of your order and is intended for the Services of LCP SARL. Personal data is processed in accordance with Law No. 78-17 of January 6, 1978, as amended, known as "Informatique et Libertés" and Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, known as the General Data Protection Regulation (GDPR).
The purposes, recipients, retention periods and conditions under which LCP collects and processes personal data are presented in the “ PRIVACY POLICY » of the site, which details all the information relating to the processing of personal data as well as the rights of the persons concerned in connection with this processing.
Alcohol abuse is dangerous for your health. Consume in moderation. The sale of alcoholic beverages to minors under the age of 18 is prohibited.

The items offered are those listed in the catalog published on the DOMAINEDJABOURIAN.COM website. These items are offered while stocks last. Each item is accompanied by a description provided by DOMAINEDJABOURIAN.COM. The photographs in the catalog are as accurate as possible but cannot guarantee perfect similarity with the item offered.
Geographic area
The online sale of items presented on the site is reserved for buyers who reside in mainland France, Switzerland, Luxembourg, Belgium and Monaco.
Rates
The prices listed in the catalog are inclusive of VAT in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the items. LCP reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the Customer. The prices indicated do not include order processing fees. Prices are valid only for mainland France, Switzerland, Luxembourg, Belgium and Monaco.
Shipping costs, customs taxes and formalities are the sole responsibility of the Customer.
Orders
The Customer places an order on the website “www.domainedjabourian.com”. To purchase one or more items, the Customer must follow the following ordering process:
– Choice of items and addition to the basket
– Validation of the contents of the basket
– Identification on the website and registration on the identification form on which he will indicate all the requested contact details
– Choice of payment method and acceptance of the T&Cs
– Payment validation
The Customer will receive an order confirmation email.
The Customer may view the details of their order and its total price at any time during the ordering process and correct any errors before confirming it to express their acceptance.
LCP reserves ownership of the items until full payment of the order, i.e. receipt of the price of the order by LCP SARL.
LCP SARL reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order or a Customer who does not have the capacity to contract. Any order constitutes acceptance of the prices and descriptions of the items available for sale.
LCP undertakes to honor orders received on the website only within the limits of available stocks.
Payment terms
Payment for purchases is made via one of the following means, at the Customer's convenience:
– By credit card

Control of orders
Given the increase in fraud recorded in the context of online commerce and in order to secure payments, for any order placed by a customer on the DOMAINEDJABOURIAN.COM website, LCP SARL will carry out a check of the elements of the order before delivery.
In application of article L 3342-1 of the public health code, prohibiting the sale of alcohol to minors under eighteen (18) years of age, the customer undertakes by validating his order to be 18 years of age or older. LCP SARL reserves the right to ask the customer for a copy of a valid identity document which will confirm the majority of the Customer. In cases where LCP SARL makes this request to the customer, failure to present a valid identity document will result in the cancellation of the order by the company LCP SARL.
LCP SARL reserves the right to refuse an order for a legitimate reason. This legitimate reason may include suspicion of fraud related to the abnormality of the order.
In any event, any order will be honored within the limits of available stocks.
Shipping and delivery times
The indicative delivery time for French customers is as follows:
– France: 24 hours at home, for any order validated before 12 p.m.
Any order placed and paid for on the DOMAINEDJABOURIAN.COM website before 12 p.m. Monday to Friday (excluding weekends and public holidays) will be prepared and shipped the same day, subject to payment validation.
LCP SARL undertakes to deliver orders placed by the Customer within the specified timeframe. If the said items have not been delivered after a period of 7 working days from the delivery date specified at the time of the order, and if this delay is not due to a case of force majeure, the Customer may cancel the sale by sending a registered letter with acknowledgment of receipt to the following address: LCP SARL – 3 Allé Michael Faraday 42400 Saint-Chamond. The amounts paid by the Customer will then be fully refunded.
By way of exception, during the period of high activity from December 1 to January 31, the Customer may proceed with the resolution under the same conditions after a period of 10 working days from the delivery date scheduled at the time of the order, and if this delay is not linked to a case of force majeure.
The Customer has 30 working days from the date of dispatch of the order to report non-receipt and request cancellation of the sale and reimbursement of the items.
The Customer must inform LCP SARL as soon as possible of any failure to receive the order following its shipment. After this period, no cancellation of the sale will be accepted.
If the goods are not received within 30 days, LCP may offer the customer the option of reshipping the undelivered goods at LCP SARL's expense.
The customer is responsible for checking the condition of the delivered items. Any anomalies noted (missing items, damaged package, broken items, etc.) must be reported to LCP SARL within 3 days of receipt.
Circumstances beyond our control
We cannot be held responsible for any loss, damage, error or failure to deliver a shipment if it is established that circumstances exist beyond our control. "Circumstances beyond our control" include, but are not limited to:
– unforeseeable circumstances or force majeure, including in particular: earthquakes, cyclones, storms, floods, wars, road, train and plane accidents, embargoes, etc.
– any defects or particularities linked to the nature of the shipment even if they were known to us at the time of our acceptance,
– any act, omission or negligence of any third party, for example: the recipient, any interested third party, any customs employee or any other administration, the postal services, any carrier or other third party to whom the shipment is entrusted by our transport provider, to serve areas not served directly by itself, even if the sender has not requested or been informed of the use of a third party.
Indirect damages
In the event of non-compliance with our commitments and whatever the cause, LCP SARL will only be liable for the reimbursement of the delivery service subject to the reservations set out above (Delay in Delivery) and in no case for indirect damages that the customer may claim. These indirect damages and losses include in particular any loss of income, profits, interest or markets and any loss linked to the impossibility of using all or part of the shipment.
Breakage during shipping
If a package arrives damaged (the bottle(s) are broken), the recipient must refuse the package. The carrier will inform LCP SARL. Upon receipt of this information, LCP SARL undertakes to immediately resend the recipient an identical package. Under no circumstances may the customer demand a refund for the product and the delivery charge.
Withdrawal period: exchange or return
Customers, non-professional individuals, benefit from a withdrawal period of fourteen (14) days from the delivery of their order to return the product to LCP SARL for exchange or refund without penalty.
Return shipping costs are the responsibility of the Customer. The Customer will be fully refunded as soon as possible and no later than 14 days after the date on which they exercised their right of withdrawal, subject to receipt of the order.
Conditions of exchange and return for refund
Returned items must be intact, unopened and in perfect condition. They must be returned in a condition suitable for resale.
The Customer must return the item using the carrier of their choice at their own expense.
The customer must keep proof of delivery of the package to the service provider responsible for the return. Without this proof, no exchange or refund will be made in the event of loss of the package.
Responsibility
LCP SARL shall not be held liable in the event of non-performance of the contract, in the event of out of stock or unavailability of the product, force majeure and, in particular, in the event of a total or partial strike, flood, fire or other natural disasters and, in general, any events preventing the proper execution of the order.
Electronic signature
The "OK" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitute an electronic signature. This electronic signature has the same value, between the parties, as a handwritten signature.
Evidence
The computerized records, stored in LCP's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
Legal guarantees
The products offered for sale by LCP SARL are covered by legal warranties. In order to assert their rights, the Customer must inform LCP Company, by registered letter, of the non-conformity of the Products within the legal time limits. LCP Company will refund or replace Products deemed non-compliant or defective, once the customer has returned the non-compliant or defective product.
Refunds for Products deemed non-compliant or defective will be made as soon as possible following the Seller's discovery of the lack of conformity or hidden defect. The refund will be made using the same means of payment as that used by the Customer for the initial transaction.
LCP alerts the customer about the characteristics of the products sold and the fact that wine is a living material which requires compliance with certain storage conditions such as temperature control, light, and humidity as well as the removal of harmful or toxic substances (bad odor, hygiene, etc.), the buyer must take all necessary measures for its proper conservation.
LCP SARL cannot be held liable for the defective nature of the product if it is proven that these conditions have not been respected. The Customer can choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code.
